High Court of Bombay at Goa on Wednesday issued noticed to all parties in the petition filed by Edgar Ribeiro, Goa Bachao Abhiyan and an NGO challenging the legality of the Panaji ODP notified on December 28, 2016.
The petition is filed challenging the revised Outline Development Plan (ODP) notified on December 28, 2016 which is now in force for the city of Panaji and for an order restraining the authorities from indulging in frequent and non-transparent ODPs unrelated to the city’s carrying capacity of traffic, transport, infrastructure and other basic services.
The petition states that if the impugned changes are allowed to prevail, the original character, identity and functioning of the city of Panaji would deteriorate beyond recognition, and the city and its services would eventually collapse as the city will be taken over by real estate developers and speculators with huge number of speculative projects approved on ad hoc basis, defeating all the opportunities of a planned environment for the citizens and residents of the city – a right guaranteed under Article 21 of the Constitution of India.
Therefore, the notification, in so far as it sanctions the impugned changes, needs to be quashed and set aside in public interest. The matter has been posted to March 12 for responses to be filed before March 7.
